Lawful Development Certificate for an existing use - Use as dwelling house.
If the time period under consideration is 4 years, as presumably the mobile homes are not classified as a “dwelling”, then the application must fail as they were unoccupied for 6 years prior to the application.
The case study from the Development Control Practice Manual concludes that the “abandonment” concept did not apply to a mobile home which the inspector describes as a “chattel”, but that a material change of use to storage of a mobile home had occurred when the occupants moved out. Therefore it is considered that not only does the current application fail but that a new appplication should be made for “change of use” for the storage of the mobile homes on this site.
